Serve a Notice of Intent

Provide a written Notice of Intent to File if the eviction is due to non-payment of rent. Maryland law requires at least 10 days for tenants to pay overdue rent before filing. File an Eviction Complaint

File an Eviction Complaint

If the tenant fails to pay landlord can file a Failure to Pay Rent complaint with the Baltimore County District Court. Court filing fees in Baltimore County are approximately $285.

The Included Services:

  • Preparation and filing of the Failure to Pay form.
  • Sending a collection letter to your tenant.
  • Representation in court on your behalf.

File the Eviction Case in District Court

  • Both the landlord and the tenant will receive a hearing date. Landlord should bring all necessary documentation such as lease agreements and proof of unpaid rent. If the court rules in the landlords favor it will receive a judgment for possession.
  • If the tenant does not vacate landlord can request a Warrant of Restitution from the court. This authorizes the Baltimore County Sheriff to enforce the eviction.
  • Contact the Baltimore County Sheriff's Office to coordinate the eviction date. Providing a final courtesy notice to the tenant may help ensure a smooth process.
  • On the scheduled date, the Sheriff oversees the eviction to ensure legal compliance.

Key Considerations

  • Self-help evictions are illegal – landlords cannot change locks or remove tenants without a court order.
  • Legal consultation is recommended to navigate complex eviction laws.

By following these steps landlords can legally and efficiently evict tenants in Baltimore County while complying with local housing regulations.
